FSSAI Issues 10 Notices to Swiggy Instamart Over Alleged Food Safety Violations

The Food Safety and Standards Authority of India (FSSAI) has issued 10 separate notices to Swiggy Instamart following multiple consumer complaints alleging the sale of expired, contaminated, damaged, and unsafe food products through its quick-commerce platform.

The notices, issued under the provisions of the Food Safety and Standards Act, 2006, seek detailed explanations from the Food Business Operator (FBO) and require immediate corrective measures to ensure consumer safety and regulatory compliance.

Summary of the 10 Notices Issued by FSSAI

Notice 1: Expired Health Supplement

Product: Healthify 100% Whey Protein (1 kg)

A consumer alleged that an expired pack of Healthify 100% Whey Protein was delivered through Swiggy Instamart. FSSAI directed the FBO to explain how an expired product entered the supply chain and to provide evidence of stock monitoring and inventory control.

Notice 2: Expired Packaged Snack

Product: NOICE Homestyle Madras Mixture with Peanuts

FSSAI received a complaint regarding the sale of an expired packet of NOICE Homestyle Madras Mixture with Peanuts. The authority sought details of stock rotation practices, warehouse management, and corrective actions implemented by the company.

Notice 3: Unsafe Eggs

Product: Akshayakalpa Organic Eggs

A consumer reported receiving expired and rotten eggs with a foul odour and visible deterioration. FSSAI directed Swiggy Instamart to investigate storage conditions, transportation practices, and supplier controls, and to submit corrective and preventive action plans.

Notice 4: Spoiled Ready-to-Eat Food

Product: Kakke Da Paratha

The complaint alleged that Kakke Da Paratha was delivered spoiled, with an unpleasant odour, rendering it unsafe for consumption. FSSAI requested evidence of temperature control, storage practices, and food safety monitoring.

Notice 5: Unsafe Infant Food

A complaint involved an infant food formulation that was allegedly received in a highly deteriorated condition. The complainant further alleged that the replacement product supplied was also unsafe. FSSAI sought an explanation regarding product handling, traceability, and consumer complaint resolution.

Notice 6: Contaminated Milk

FSSAI received a complaint concerning contaminated milk supplied through the platform. The authority requested records relating to supplier verification, cold-chain maintenance, storage conditions, and quality assurance procedures.

Notice 7: Damaged Packaged Food Products

Consumers reported receiving damaged packaged food products that were allegedly unsuitable for sale. FSSAI directed the company to strengthen warehouse inspections, packaging integrity checks, and transportation controls.

Notice 8: Incorrect FSSAI Licence Details

The authority observed discrepancies relating to incorrect or invalid FSSAI licence numbers displayed on certain food products. Swiggy Instamart was directed to verify the licensing status of all Food Business Operators operating through its platform.

Notice 9: Unauthorised Product Category

FSSAI observed that NOICE Eggs were allegedly marketed under a product category not covered under the existing FSSAI licence. The company was instructed to immediately stop marketing products outside the approved licence scope and ensure compliance with licensing requirements.

Notice 10: Food Safety Compliance and Consumer Grievance Management

The tenth notice focused on systemic compliance issues, including:

  • Seller onboarding procedures

  • Food safety compliance verification

  • Product traceability

  • Inventory management
