FSSAI Cracks Down on Misleading Food Labels: Notices Issued to Lotte India, Kubera Foods & Ferns N Petals

The Food Safety and Standards Authority of India (FSSAI) has issued notices to Lotte India Corporation Private Limited, Kubera Foods, and Ferns N Petals Private Limited after identifying multiple instances of misleading food claims and labelling non-compliances on various packaged food products. The notices highlight violations related to unauthorized pre-printed labels, misleading front-of-pack claims, incorrect product descriptions, and mandatory declaration deficiencies under the Food Safety and Standards Regulations.

According to FSSAI, Lotte India was found using non-compliant pre-printed labels bearing its old company name without prior approval and making misleading claims such as "100% Vegetarian" on selected Choco Pie variants. The authority also observed missing nutritional information on PEPERO Biscuit Sticks and non-compliance with vitamin claims on LOLLY BLISS Lollipops. Additionally, FRUITZ Eclairs were flagged for using a product name that could mislead consumers into believing the products contained fruit, while the required disclaimer was absent from the front of the pack. Kubera Foods received a notice for marketing Soft and Fresh Cream Bun Pineapple with claims including "100% Natural" and "No Preservatives, Colours & Flavours", despite the product label declaring preservatives, synthetic food colour (INS 110), and added flavouring substances. Ferns N Petals was similarly cited for marketing Roasted Almond Chocolate as "Premium Chocolate" despite containing hydrogenated vegetable fat, while also failing to provide mandatory declarations for vegetable fat, %RDA values, and almond content disclosure.

FSSAI has directed all three companies to submit their explanations within seven days, stating why regulatory action should not be initiated under the Food Safety and Standards Act, 2006 and the applicable Rules and Regulations. The enforcement action reflects the regulator's continued focus on ensuring truthful food labelling, transparent ingredient disclosure, and preventing misleading claims that may influence consumer purchasing decisions.
